The short version
- 21 or older, with a valid government photo ID
- Licensed stores only: look for the state's verification sticker
- Up to 3 oz of flower and 24 g of concentrate a day
- Tobacco smoking rules apply, plus a few extra limits
Who can buy
Adults 21 or older with a valid government photo ID can buy cannabis at a licensed adult-use dispensary in New York. You do not need a medical card.
Where to buy legally
Only stores licensed by the Office of Cannabis Management can sell cannabis. Licensed shops post the state's verification sticker near the door, with a QR code you can scan to confirm the license. You can also look any store up at cannabis.ny.gov.
How to spot an unlicensed shop
Unlicensed shops may sell THC products that have not been through state testing, with labels that do not meet state rules. No verification sticker, no license number and no ID check before the sale are all reasons to walk out.
What to bring
Your ID and a way to pay. Payment options vary by store, so check before you go.
Ordering delivery
Licensed dispensaries can deliver to addresses in their delivery area. The driver hands the order only to the person named on it, after checking their photo ID, so plan to be there when it arrives.
Where you can use it
New York lets adults smoke cannabis where tobacco smoking is allowed, with exceptions: not in a car, and not in parks, pedestrian plazas or indoor spaces covered by the smoking ban.
